Accident  and Emergency

This is often the first point of contact a patient will have with the NHS due to an illness or after an injury. The staff who practise in emergency medicine have skills in prevention, diagnosis and management.

Case reports

T -v- Calderdale & Huddersfield NHS Trust

The Claimant was taken to the Accident & Emergency Department at Calderdale Royal Infirmary after being knocked down by a car
and was diagnosed as having an unstable short spiral fracture of the right femur.  Her leg was placed in a splint which had to be re-applied because it was the wrong size.  She was admitted to the children’s ward of the hospital. She remained in hospital but there was a failure to monitor the healing process of her leg in the splint, to the extent that poor union of the femur was achieved and her leg was bent when the bone was healed and had a boney protruberance. The bowing of the leg also entailed shortening of the femur and consequently the leg itself.

The case settled for £28,000.00 which included damages for care provided to the Claimant by her parents, the cost of some reconstructive surgery on her scarring and damages for her psychological distress, as well as for the leg injuries overall and for the otherwise would have been unnecessary.

Specialist clinical negligence solicitor to join John Pickering and Partners LLP

John Pickering and Partners LLP are delighted to announce that a new solicitor, Rachel Donovan, will be joining the firm on the 17th August 2009.

Rachel is an experienced clinical negligence solicitor who has worked on behalf of victims of medical accidents for the last 8 years at a claimant firm of solicitors in Liverpool. She joins to develop the firm’s existing clinical negligence department and to particularly expand operations in their Liverpool office.

Rachel is a member of the Law Society Clinical Negligence Panel for specialist lawyers, a qualification that requires demonstration of a high standard of competence in handling clinical negligence claims.

Rachel has been involved in a number of high profile clinical negligence cases including the Alder Hey Organ Retention Litigation and claims concerning cerebral palsy and Cauda Equina Syndrome. Rachel has dealt with a varied medical negligence caseload including claims arising out of cardiology, obstetrics, oncology, gynaecology in hospitals and treatment from GP’s.

Rachel is a well known personality in the Liverpool legal community and will continue to contribute to her blog in the Legal Week feature of the Liverpool Daily Post. She grew up in Liverpool and now lives with her family in Crosby.

The firm already has a well established clinical negligence practice based in its Manchester office and Rachel’s arrival will mean that they can offer improved services to victims of medical accidents who live in Merseyside and the surrounding area.

Kevin Johnson, partner at the firm’s Liverpool office said:-

“I am delighted to welcome Rachel to the firm. Her arrival will enable us to offer a better service to local people who have suffered negligence when receiving medical treatment. I hope that we are already well known for the high standards of service that we offer to asbestos sufferers and other industrial disease clients and that we will become as well known locally for our clinical negligence work.”
Rachel says:

"I am so excited to be joining the team at John Pickerings and Partners and to be expanding the medical negligence work that they do, to the Merseyside area. The firm has a national reputation for the work it does and I know how committed they are to helping people who have been involved in medical accidents.

I have been specialising in medical negligence claims for over 8 years and I am dedicated to this area of the law. I have gained specialist knowledge through the cases that I have dealt with, which include iron overload litigation and genetic cancer cases, which allows me to deal with the complexities of medical negligence.”

About us

Our clients are people who have suffered injury as a result of a medical accident in the UK. We guarantee that all our clients will have their case dealt with by a specialist solicitor who has chosen a career in compensation work for injured people. We do not do other sort of work. Most cases we take on are won or settled out of Court with compensation paid to our clients. Please click here to see our dedicated clinical negligence website.

We are committed to providing public funding (previously known as Legal Aid) and have a Franchise from the Community Legal Services Commission. This means they have looked at the firm carefully and approve of the way we work. They trust us to handle medical accident claims properly. Not many firms have a Franchise since the criteria is high.

Many clients are not eligible for public funding since public funding is only available to those with very limited income and capital. If you are not eligible, we can offer a Conditional Fee Agreement with insurance or you may have legal expenses insurance. We shall check the best method of funding your claim. All 3 of our offices (Liverpool, Manchester and Halifax) are accredited by the Association of Personal Injury Lawyers. We only act for victims of medical accidents unlike other firms who also act for doctors and Hospital Trusts.

In 2007 we received an award from Liverpool Law Society of Specialist Law Firm of the Year. In 2009 we were given an award from Liverpool Law Society of Personal Injury Team of the Year. We are consistently highly ranked by legal guides for the personal injury work that we do. The respected legal guide, Chambers and Partners, ranks us in the highest tier possible, as one of the “Best of the UK” for claims that we do for industrial disease victims.

The firm has been involved in several high profile test cases on behalf of asbestos sufferers that have proceeded to the Court of Appeal and the House of Lords. Some of these cases are being used to help clarify the law and assist injured people in other areas including, for example, medical negligence, when medical science is incomplete and may mean that they are otherwise unable to establish liability.
