Accident  and Emergency

This is often the first point of contact a patient will have with the NHS due to an illness or after an injury. The staff who practise in emergency medicine have skills in prevention, diagnosis and management.

Case reports

T -v- Calderdale & Huddersfield NHS Trust

The Claimant was taken to the Accident & Emergency Department at Calderdale Royal Infirmary after being knocked down by a car
and was diagnosed as having an unstable short spiral fracture of the right femur.  Her leg was placed in a splint which had to be re-applied because it was the wrong size.  She was admitted to the children’s ward of the hospital. She remained in hospital but there was a failure to monitor the healing process of her leg in the splint, to the extent that poor union of the femur was achieved and her leg was bent when the bone was healed and had a boney protruberance. The bowing of the leg also entailed shortening of the femur and consequently the leg itself.

The case settled for £28,000.00 which included damages for care provided to the Claimant by her parents, the cost of some reconstructive surgery on her scarring and damages for her psychological distress, as well as for the leg injuries overall and for the otherwise would have been unnecessary.

100 of Foreign Doctors “not checked”.

Hundreds of foreign doctors working in Britain have not been checked for language skills or competency, according to recently obtained figures.  Despite widespread outrage over the case of a German doctor with poor English, whose actions led to the death of a pensioner, less than 1 in 4 foreign doctors are currently being properly verified, according to a Freedom of Information Request.

The investigation that was undertaken by Pulse, a newspaper for GP’s, also found that many NHS Trusts in England have no accurate record about whether or not the doctor has been checked.

NHS Trusts need to ensure that overseas doctors who come to work in the UK are fully equipped with the skills that they need to provide the right level of care.

Today’s survey of more than 100 Primary Care Trusts show hundreds of foreign doctors are included on “performance lists” without having been fully checked.

More than two thirds of NHS Trusts admitted that they did not collect data on whether doctors had been checked.

Niall Dixon, Chief Executive of the General Medical Council said: “The Pulse survey appears to show willing failings in the system of employers’ checks, which could put patients at risk”.

Rachel Donovan, one of the specialist Solicitors in the clinical negligence team at John Pickering and Partners said: “I am horrified by the result of this survey produced by Pulse’s latest research and it is worrying to think that in more than two thirds of Trusts no data is being collected about whether the skills levels of these doctors have been checked.  We have dealt with many cases relating to the care provided by foreign doctors which have led to devastating mistakes, impacting victims and their families.  Lessons now need to be learned from this report”.
